General Terms of Business

We operate on the basis of the valid version of the “General Austrian Forwarders Terms and Conditions (AOSP)” and “Conditions of Carriage for Furniture Transport” published in the Wiener Zeitung.

Limitation of Liability

With the exception of damage claims due to errors in guaranteed characteristics, in accordance with product liability law, all claims to damages (e.g. due to faults in contract negotiation, positive contract violation, unlawful actions) against us are excluded unless they are based on intent or gross negligence of our legal representatives or executives, or intent or gross negligence of our fulfilment or operational help. With regard to delay and impossibility, we also bear liability toward non-traders in the event of negligence, but only in the amount of additional expenses for covering purchases or substitute performance. In the event of violation of significant contractual obligations (‘cardinal obligations’) we are liable for simple negligence of our legal representatives and executives, but only limited to typical and foreseeable damages.

If Spedition Lang GmbH is liable as a co-debtor along with others, they are constantly only subsidiary in the last position.

Spedition Lang GmbH is only liable for the loss of data if they have backed up the data in appropriate intervals, at least once per day in a machine-readable form.

The existing liability limitations also apply for the benefit of our legal representatives, executives and fulfilment and vicarious agents.

Austrian law applies; the Vienna Commercial Court is appointed for all legal disputes which arise due to or in connection with this exclusion of liability and/or with any content of this website, if no obligatory legislation opposes it.

AEO Security Declaration

Spedition Lang GmbH is an authorised economic agent (AEO-F) based on the regulations EU VO 648/2005 and 1450/2006, which focus on securing the supply chain. Therefore, all customers, partners, suppliers and subcontractors are instructed to adhere to corresponding safety measures which fulfil the performance standards and regulations of the secure supply chain.

Foreign Trade Limitation

The client has checked all relevant goods and persons/businesses with regard to any international and national foreign trade limitations (sanctions and embargos) before approving transport and/or customs orders to Spedition Lang GmbH and explains that, at the time of the order approval, no foreign trade bans or limitations exist in accordance with the valid provisions. Spedition Lang GmbH is not subject to inspection obligations.

In the event that service to be provided, or parts thereof, contradict the regulations according to legal provisions, including but not exclusively limited to US law, EU or national regulations affecting provisions against terrorism and embargos, Spedition Lang GmbH is entitled to partially or fully withdraw from the contract at any time and will not bear any liability with regard to the client.
